Myfightercardstrives to be compliant with the rules set by the Intellectual Property legislation of the UK and/or any applicable international treaty and we take Intellectual Property Infringement claims very seriously. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide the following information in writing (the "Notice") pursuant to the following section:

• a specific description of the copyrighted work or other intellectual property that you claim to be infringing.
• a specific description of where the material that you claim to be infringing is located in theMyfightercard platform and/or screenshot bearing accession time, sufficient to permitMyfightercard to locate the material;
• Your address, phone number and email address;
• A statement by you that you have a good faith belief that the intellectual property rights have been infringed.
• A statement by you that the information in your Notice is accurate and a statement made under penalty of perjury that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.
• An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.

Once we receive infringement notification, we may remove or disable access to the material immediately.

Notice will be deemed void, if you fail to comply with all of the aforementioned Notice requirements in writing and we will ignore such incomplete or inaccurate notices without liability of any kind.

If you knowingly misrepresent that material is infringing, was removed by mistake or misidentification may be subject to liability.

If you create design/products withMyfightercard to be displayed and/or offered for "distribution" (i.e., for use on digital or physical products) on websites, mobile sites, via marketplace listings, and/or apps that are:

• owned or operated by or forMyfightercard, or
• On MyfightercardMyfightercardPlatform on which products are displayed and posted for sale.

Make sure that content you upload and/or use onMyfightercard is in the public domain, or you are the owner of the content;

You have the legal right to grant this license toMyfightercard and to enter into direct undertakings;

To your knowledge, no one else claims ownership of, or exclusive rights to, the Content;

The Content does not infringe the privacy, celebrity, moral or other rights of any third party;

The Content does not contain any defamatory, obscene or discriminatory content or any illegal material;

By creating and/or uploading content toMyfightercard you grant the following licenses to us: the nonexclusive, worldwide, transferable, sublicensable right to use, reproduce, publicly display, sell, and distribute the content in or on products and in advertising, marketing, samples, and promotional materials for the purpose of promoting our platform, your content and products.

You also grant us the license and the right to make modifications to your content as necessary for viewing/download/sale on a particular product, as applicable, or for other manufacturing or platform-related purposes.
You retain all copyright and other intellectual property rights in your content. You may delete or hide your content at any time, but due to caching and other technical issues, it may take a number of days for it to be completely removed fromMyfightercard. Upon the removal of content, the licenses above will terminate, except thatMyfightercard may continue to use or access your content to fulfill any orders placed prior to termination, in marketing and promotional materials if such materials were created prior to removal of the content, and to defend against or respond to infringement claims.
You will make best efforts to provide accurate, non-misleading, non-infringing information about your content and you agree not to submit unrelated information in connection with your content for any purpose.

IfMyfightercard determines that your information is misleading or inaccurate or that it violates the rights of a third party, we may delete such information/content entirely, and/or terminate your account, in its sole discretion.
By usingMyfightercard, you agree to use the platform in a manner that demonstrates common sense and respect for the rights of Myfightercard, users and third parties, and in accordance with applicable laws and regulations.
We may take the following actions to enforce the terms:

(a) Send a notification informing you of the offending action and request that you take corrective action immediately;

(b)Make content or product(s) unavailable;

(c) Delete content or product(s);

Additionally, we reserve the right at any time to remove, limit, suspend, terminate our service and user accounts, prohibit access to the platform and any related content, services and tools, delay or remove products from the platform and discontinue our relationship with any users who we determine in our sole discretion are in violation of the above-listed guidelines, including but not limited to content that infringe the intellectual property rights of third parties, or are unlawful, fraudulent, threatening, libelous, defamatory, obscene or otherwise objectionable.

SECTION 15 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

In no case shall Myfightercard, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
